Joint Parental Consent & Guardianship
Under Indian civil law, minors cannot independently execute legal instruments. Therefore, any modification to a minor child's name, surname, or spelling requires a joint sworn declaration by both living parents acting in their capacity as natural guardians under the Hindu Minority and Guardianship Act, the Guardians and Wards Act, or respective personal laws.
If one parent is deceased, a certified copy of the death certificate must be attached. In cases of contested divorce where sole legal custody has been awarded by a Family Court, the custody decree must be cited to establish legal authority to alter the child's records.
CBSE & ICSE Board Registration Deadlines
Timing is of the essence when changing a child's name. Both CBSE and ICSE enforce rigid examination bye-laws. Once a student's List of Candidates (LOC) is submitted for Class 9/10 or Class 11/12, modifying the candidate's name requires an extensive bureaucratic review or a court writ petition.
Parents must ensure that the Gazette notification is completed and submitted to the school principal prior to the final submission of board examination registration data.
Stepfather Surname Adoption: Supreme Court Ruling
In the historic ruling of Akella Lalitha v. Sri Konda Hanumantha Rao (2022), the Supreme Court of India held that a mother, as the only natural guardian after the demise or divorce of the biological father, has the full legal prerogative to decide the surname of the child and include the name of her new husband (the stepfather) in official records.
Following this precedent, Gazette applications for adopting a stepfather's surname are approved when supported by a properly drafted affidavit citing this judicial ruling.
The 5-Step Procedural Workflow
- Execute a joint parental affidavit on ₹10 to ₹100 stamp paper before an Executive Magistrate or Notary.
- Publish announcements in two daily newspapers (one English national and one regional daily).
- Obtain a Bonafide Certificate from the child's school principal confirming enrollment and current registered name.
- Submit the Minor Gazette Proforma and CD to the Controller of Publications, Delhi.
- Apply to update school admission registers, Aadhaar, and Passport with the published e-Gazette.
